## Short answer

A fall on public land has special rules. You may need to prove that the walkway had a dangerous defect. You may also need to file an early claim with the public agency.

## Hypothetical example

A person trips on a raised slab in a public walkway and gets hurt.

## How the rule works

Government Code § 835 sets requirements for dangerous-condition claims against public entities. Government claim presentment is a separate requirement.

## What can change the answer

Not every crack is a legal danger. Size, light, and the area around it matter. You may need to show who controlled the walkway and what they knew.

## A useful next step

Take photos that show the defect and the whole area. Check the claim time limits right away.

## Court decisions behind this answer

### Huckey v. City of Temecula (2019)

37 Cal.App.5th 1092, slip op., pp. 12–18. The court looked at the sidewalk defect and the whole setting. On those facts, it found the defect too minor to support the claim.

Limit: There is no universal inch rule. The whole setting and current law matter.

### State of California v. Superior Court (Bodde) (2004)

32 Cal.4th 1234, slip op., p. 1. Before suing a public agency, a person may need to send it a formal claim. The court required the lawsuit to address that step or a valid excuse.

Limit: This does not list every deadline. It does not excuse a late claim.
