# Is opening an insurance claim the same as suing?

## Short answer

No. An insurance claim asks an insurer to handle a loss. A lawsuit starts a court case. One does not automatically replace the other.

## Hypothetical example

An adjuster reviews bills for months. That review alone does not stop the lawsuit filing clock.

## How the rule works

A claim number is not a court case number. Filing a lawsuit requires court papers and other steps. Talks with an adjuster may continue while the court filing deadline gets closer.

## What can change the answer

An agreement or a specific legal rule might affect timing, but you should not assume a conversation paused a deadline.

## A useful next step

Track claim numbers and court deadlines separately. Keep written copies of important communications.

## Court decisions behind this answer

### Fox v. Ethicon Endo-Surgery, Inc. (2005)

35 Cal.4th 797, slip op., pp. 1–2. The court asked when a person had reason to suspect harm and a wrongful cause. That can affect when the time to sue starts.

Limit: This case explains when a legal claim may accrue. It does not hold that opening an insurance file is the same as filing court papers.
